Introduction

Thomson Research Associates, Inc. (“TRA”) is committed to the appropriate protection and use of personal identifiable information that has been collected via our website, www.ultra-fresh.com. This Privacy Policy is intended to be a worldwide venture, is applicable to all data collection by TRA and shall apply to your use of this website or mobile applications, QR codes, your use of any affiliated third party websites that may contain a link to this Privacy Policy, or to any pages, facilities, services, or capabilities accessible on or by any TRA domain owned by us (each, a “Site” and collectively the “Sites”). This Privacy Policy governs the way TRA collects data from you (“User” or “you”) on the Sites.

Our Privacy Policy explains: what information we gather and why we save it; how we utilize it and the options we offer, including how to retrieve and update information.  By using the Sites, you agree with our Privacy Policy. If you do not approve of our Privacy Policy, please do not use the Sites. Please let us know if you have any questions.

We collect information, including personal data, to provide better services to all our Users.

Information You Share

When you use some TRA services, applications or post on a TRA forum or social networking service, the personal information and content you share is visible to other users and can be read, collected, or used by them. You are responsible for the personal information you choose to share or submit in these instances. For example, if you list your name and email address in a forum posting, that information is public. Please take care when using these features.

Information We Share

We do not share personal information with companies, organizations and individuals outside of TRA unless one of the following circumstances applies:

  • With your consent. We will share personal information with companies, organizations or individuals outside of TRA when we have your consent to do so. We require opt-in consent for the sharing of any sensitive personal information.
  • For external processing. We provide personal information to our affiliate or other trusted businesses or persons to process it for us, based on our instructions and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures. These third parties includes Salesforce and Google Analytics.
  • For legal reasons. We will share personal information with companies, organizations or individuals outside of TRA if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:
    • meet any applicable law, regulation, legal process or enforceable governmental request.
    • enforce applicable Terms of Use, including investigation of potential violations.
    • detect, prevent, or otherwise address fraud, security or technical issues.
    • protect against harm to the rights, property or safety of TRA, our users or the public as required or permitted by law.

We may share non-personally identifiable information publicly and with our partners – like advertisers or connected sites. For example, we may share information publicly to show trends about our products and services.

If TRA is involved in a merger, acquisition or asset sale, we will continue to ensure the confidentiality of any personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.

How TRA Protects Personal Information

We work hard to protect TRA and our users from unauthorized access or unauthorized alteration, disclosure or destruction of information we hold. In particular:

  • We encrypt many of our services using SSL.
  • We review our information collection, storage and processing practices, including physical security measures, to guard against unauthorized access to the system.
  • We restrict access to personal information to TRA employees, contractors and agents who need to know that information to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.

Retention and Deletion

Personal identifiable information that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes. We will retain your personally identifiable information as follows: name, email address, phone number, job title, company name will be retained for a minimum period of 30 days following the date that you complete a contact form on our Sites, and for a maximum period of 60 months following the date that you consent for us to store your personal information. In some cases, it is not possible for us to specify in advance the periods for which your personally identifiable information will be retained. In such cases, we will determine the period of retention based on the following criteria: the period of retention of name, email address, phone number, job title, company name will be determined based on the nature of the inquiry information included within the contact form submission, or lack thereof. Notwithstanding the other provisions of this section, we may retain your personally identifiable information where such retention is necessary for compliance with a legal obligation to which we are subject, or to protect your vital interests or the vital interests of another natural person.

When this Privacy Policy Applies

Our Privacy Policy applies to all the services offered by TRA but excludes services that have separate privacy policies that do not incorporate this Privacy Policy.

Our Privacy Policy does not apply to services offered by other companies or individuals, including products or sites that may be displayed to you, or other sites linked from our services. Our Privacy Policy does not cover the information practices of other companies and organizations who advertise our services, and who may use cookies, pixel tags and other technologies to serve and offer relevant ads.

Third Party Links

The Sites may contain links to webpages operated by parties other than TRA. We do not control such websites and are not responsible for their contents or the privacy policies or other practices of such websites. Our inclusion of links to such websites does not imply any endorsement of the material on such websites or any association with their operators. Further, it is up to the User to take precautions to ensure that whatever links the User selects or software the User downloads (whether from this Site or other websites) is free of such items as viruses, worms, trojan horses, defects and other items of a destructive nature. These websites and services may have their own privacy policies, which the User will be subject to upon linking to the third party’s website. TRA strongly recommends that each User review the third party’s terms and policies.

Children

The Sites and services are not intended for use by children. We do not intentionally gather personally identifiable information about visitors who are under the age of 13 (or, for data subjects located within a Member State of the European Union, visitors under the age of 16) (a “Child”). If a Child has provided us with personally identifiable information, a parent or guardian of that Child may contact us to have the information deleted from our records. If you believe that we might have any information from a Child, please contact us at info@ultra-fresh.com. If we learn that we have inadvertently collected the personal information of a Child, we will take steps to delete the information as soon as possible.

Information for California Residents

TRA does not respond to Do Not Track (DNT) signals. Some third-party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, your browser may include controls to block and delete cookies, web beacons and similar technologies, to allow you to opt out of data collection through those technologies.

California residents are entitled to contact us to request information about whether we have disclosed personal information to third parties for the third parties’ direct marketing purposes. We do not disclose personal information to third parties for the third parties’ direct marketing purposes. California customers may request further information about our compliance with this law by e-mailing us at the address listed in the “Contact Us” section.

Compliance and Cooperation with Regulatory Authorities

We regularly review our compliance with our Privacy Policy. When we receive formal written complaints, we will contact the person who made the complaint to follow up. We work with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that we cannot resolve with our customers directly.

Changes

Our Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services or products, email notification or privacy policy changes). We will also keep prior versions of this Privacy Policy in an archive for your review.
